photocall.ai is designed to be your personal AI-powered photo editing platform. It helps you transform images, generate photos from text descriptions, and remove backgrounds using advanced AI technology powered by Google Cloud's Gemini model. Unlike traditional photo editing apps, photocall.ai uses AI to automatically generate, transform, and edit your images.

We are based in Spain and subject to the jurisdiction of Spanish courts.
Account Responsibility: You are responsible for keeping your account secure. We support Firebase Authentication (Google Sign-in and email/password). We strongly recommend you use two-factor authentication where available.
Your Content: You are responsible for all content and activity under your account.
Age Requirement: You must be at least 16 years old to use photocall.ai. If you are under 18, you must have permission from your parent or legal guardian.
Human Users Only: Accounts created by bots or automated systems are not allowed and may be terminated.
We want photocall.ai to be a safe and productive space for everyone. You agree to use photocall.ai responsibly and not for any harmful or illegal purposes. You specifically agree not to:
AI-Specific Considerations:
While we use AI features powered by Google Cloud's Gemini model to enhance your experience, these features may occasionally generate inaccurate, unexpected, or inappropriate results. We are not responsible for content generated by AI. You use all AI-generated content at your own risk and are responsible for reviewing and ensuring the appropriateness of all outputs.
License to Operate the Service: By using photocall.ai, you grant us a license to use your content solely to operate and improve the Services for you. This includes:
No Public Sharing: We will not publicly share, sell, or distribute your uploaded content or generated images. Your content remains private to your account.
Data Minimization: We only collect and process data strictly necessary to operate photocall.ai and provide its features.
Partnership with Google Cloud: We partner with Google Cloud to provide our AI image generation and editing features using the Gemini model. Your images are processed securely through Google Cloud's infrastructure with enterprise-grade security and encryption.
Subscription Plans:
Billing Cycle: Subscriptions are billed monthly and automatically renew unless cancelled. Unused quotas do not carry over to the next month.
Payment Methods: We accept payments through Polar Inc, our trusted payment processor. All payment data is passed securely to Polar Inc for processing.
Subscription Management: You can manage your subscription through your account settings or the Polar Inc Customer Portal.
Cancellation: Canceling your subscription will prevent future charges. Your access to paid features will continue until the end of your current billing period.
Refund Policy: You can request a refund by contacting hello@photocall.ai within two (2) months of your purchase. Refunds are handled on a case-by-case basis.
Our Intellectual Property: We own all rights to the photocall.ai Platform, including its design, code, trademarks, and logos.
AI-Generated Content: You retain rights to content you generate through the Platform for personal and commercial use (based on your subscription plan). You may export and use your generated images as needed for your own purposes, subject to the terms of your subscription plan.
PHOTOCALL.AI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We make no warranties about the accuracy, reliability, or suitability of the service or any content generated by photocall.ai.
We are not responsible for:
IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, REVENUE, OR DATA ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU DURING THE TWO (2) MONTHS PRIOR TO ANY CLAIM.
Governing Law: These Terms are governed by the laws of Spain, excluding its conflict of laws principles.
Dispute Resolution: We encourage you to contact us directly at hello@photocall.ai to resolve any issues informally. If we cannot resolve a dispute amicably, any legal disputes will be subject to the exclusive jurisdiction of the courts of Spain.
These Terms are effective as long as you use photocall.ai. We may terminate your account and access to the Services at any time, for any reason, with or without notice, including if you violate these Terms. You may also terminate your account at any time by canceling your subscription and requesting account deletion.
